Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website viragemontecito.me (the "Site"), operated by Virage Montecito Rent a Car, the authorized Subaru importer for Montenegro, with its registered address at 17 Josipa Broza Tita, Podgorica 81000, Montenegro ("Virage Montecito", "we", "us"). By accessing or using the Site, you accept these Terms in full. If you do not agree with them, please do not use the Site.

These Terms of Service apply to use of the Site itself. For the rules that specifically apply to renting a vehicle, see our Rental Conditions, and for the processing of personal data, see our Privacy Policy and Cookie Policy.

The Site is used to present the Virage Montecito fleet, services and offers, and to make online vehicle rental bookings. A booking made via the Site is a rental request that becomes binding only once Virage Montecito sends a written booking confirmation, in accordance with our Rental Conditions.

When using the forms on the Site (booking, contact form, newsletter sign-up) you agree to provide accurate, complete and up-to-date information. You are responsible for the accuracy of all information you submit, and for any consequences that may result from providing inaccurate information (e.g. being unreachable to confirm a booking).

All content published on the Site - including, without limitation, text, photographs, graphics, logos, design, source code and the structure of the Site - is owned by Virage Montecito or used under appropriate licence from the rights holder, and is protected by copyright and other intellectual property laws. The "Subaru" name and associated trademarks are owned by Subaru Corporation and are used by Virage Montecito as the authorized importer/representative for the territory of Montenegro.

You may not copy, reproduce, distribute, modify, publicly display or use any part of the Site's content for commercial purposes without Virage Montecito's prior written consent, except to the extent expressly permitted by these Terms or by law (e.g. personal, non-commercial use).

You may use the Site only for lawful purposes and in a manner that does not infringe the rights of third parties or interfere with the operation of the Site. It is prohibited to: gain or attempt to gain unauthorised access to parts of the Site that are not publicly available; use automated tools (bots, scraping software and the like) to collect data from the Site without our prior written consent; introduce viruses, malicious code or any material capable of damaging or disrupting the operation of the Site; submit false, malicious or harassing messages via the Site's forms; create fake or malicious bookings; or engage in any other conduct that may compromise the security, integrity or availability of the Site.

Prices and vehicle availability shown on the Site are subject to change and may vary depending on the selected dates, location, and any extras. While we aim to keep all information on the Site accurate and up to date, we do not guarantee that pricing or availability will always be free of technical errors. In the event of an obvious error, Virage Montecito reserves the right to notify you and offer a corrected price, with the option to cancel the booking free of charge.

The Site may contain links to third-party websites and services (e.g. Google Maps, social media, and our online payment processor, Monri). Such links are provided solely for your convenience. Virage Montecito has no control over the content of those sites and is not responsible for their content, accuracy, availability or privacy practices.

The Site and its content are provided "as is" and "as available", without any express or implied warranties as to accuracy, completeness, reliability, or uninterrupted availability. Virage Montecito does not warrant that the Site will operate without interruption or error, or that any technical defects will be corrected within any particular timeframe.

To the fullest extent permitted by applicable law, Virage Montecito shall not be liable for any direct, indirect, incidental or consequential damages arising from the use of, or inability to use, the Site, including, without limitation, loss of data, loss of revenue, or business interruption, except for damages caused by Virage Montecito's wilful misconduct or gross negligence.

This limitation of liability does not apply to matters specifically governed by the Rental Conditions in respect of the vehicle rental itself.

You agree to indemnify and hold harmless Virage Montecito, its employees and associates, from any claim, loss, damage or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

Virage Montecito reserves the right, at its own discretion and without prior notice, to restrict, suspend or terminate your access to the Site if there is a reasonable suspicion that you are in breach of these Terms or that your conduct threatens the security, integrity or reputation of the Site or of Virage Montecito.

Virage Montecito reserves the right, at any time, to modify, supplement, or temporarily or permanently discontinue the Site or any part of it, as well as to amend these Terms. Amendments to these Terms take effect upon publication on this page, with the date of the last update indicated. Continued use of the Site after amendments are published constitutes acceptance of the amended Terms.

These Terms are governed by the laws of Montenegro. Any dispute arising from use of the Site that the parties are unable to resolve amicably shall be subject to the jurisdiction of the competent court in Podgorica.
