Rental Conditions

Vehicle rental conditions at Virage Montecito.

These Rental Conditions ("Conditions") govern every rental of a motor vehicle from Virage Montecito Rent a Car, the authorized Subaru importer for Montenegro, with its registered address at 17 Josipa Broza Tita, Podgorica 81000, Montenegro ("Virage Montecito", "we", "us" or the "Lessor"). By submitting a booking, signing a rental agreement and/or taking delivery of a vehicle, the customer ("Driver", "Renter" or "you") unconditionally accepts these Conditions in full. If you do not agree with any part of these Conditions, please do not complete a booking or take delivery of a vehicle.

These Conditions apply together with the website Terms of Service, the Privacy Policy, and the individual rental agreement signed at vehicle pick-up. In the event of any inconsistency between these Conditions and a signed rental agreement, the signed rental agreement prevails for that specific booking, while these Conditions remain governing for all matters the agreement does not expressly address.

1. ELIGIBILITY TO RENT

1.1 The Driver must be at least 21 years of age and hold a valid category B (or equivalent) driving licence held continuously for at least 2 (two) years prior to the pick-up date. For certain models in the Premium and Exclusive segments of the Virage Montecito fleet, we reserve the right to apply a stricter minimum age (up to 23) and/or a longer minimum licence-holding period, of which the Driver will be informed prior to booking confirmation.

1.2 At pick-up, the Driver must present: (a) a valid, original driving licence; (b) a valid national ID card or passport; and (c) a credit or debit card issued in the Driver's own name, to be used for the security deposit hold described in clause 5.3. Virage Montecito reserves the right to refuse to hand over the vehicle to any person whose documentation is invalid, damaged, illegible or suspicious, without liability for damages, while reserving the right to charge cancellation fees under clause 12.

1.3 The name on the booking, on the driving licence, and on the payment card used for the deposit must be identical. Bookings made on behalf of a third party must be expressly confirmed by the person who will physically collect the vehicle.

1.4 The vehicle may be driven only by: the main Driver named on the rental agreement, and any additional person expressly registered and approved as an additional driver via the "Additional Driver" extra, who meets all requirements of clauses 1.1 and 1.2. Any vehicle use by an unregistered driver constitutes a material breach of these Conditions and voids insurance cover in full under clause 8, with the Driver bearing full financial liability for any resulting damage.

2. BOOKING, CONFIRMATION AND PRICE

2.1 Bookings are made via the viragemontecito.me website, by phone, or by email, and are considered final once Virage Montecito sends a written booking confirmation to the email address provided by the Driver.

2.2 The rental price shown at booking includes the daily vehicle rate and applicable VAT, based on the selected dates, pick-up/drop-off location and any extras/services. The minimum rental period is 2 (two) days; bookings for a shorter period are not available through the website.

2.3 Virage Montecito reserves the right to amend its price list for future bookings, provided that the price confirmed in the written booking confirmation remains fixed and binding on both parties for that specific booking, except in the event of an obvious technical pricing error, in which case Virage Montecito reserves the right to notify the Driver and offer either a corrected price or cancellation of the booking at no charge.

2.4 All prices are quoted in euros (EUR) and include VAT as required by law, unless expressly stated otherwise.

3. VEHICLE PICK-UP AND DROP-OFF

3.1 Vehicle pick-up and drop-off is currently available exclusively at the following locations: (a) the Virage Montecito Subaru showroom in Podgorica, and (b) Podgorica Airport. Virage Montecito reserves the right to introduce additional pick-up/drop-off locations from time to time, with customers notified via the website.

3.2 The vehicle is handed over and returned at the agreed time stated in the booking confirmation. Virage Montecito allows a 2 (two) hour grace period before a late return begins to be treated, and charged, as a rental extension under clause 10.

3.3 In the event of a delayed flight, the Driver must provide the flight number at booking, or as soon as reasonably possible; Virage Montecito tracks arrivals at Podgorica Airport and adjusts the pick-up time free of charge within reasonable limits of delay.

3.4 If the Driver fails to collect the vehicle within 3 (three) hours of the agreed pick-up time without prior notice, the booking is treated as cancelled by the Driver ("no-show"), and the cancellation provisions in clause 12 apply.

4. THE VEHICLE, FUEL AND MILEAGE

4.1 The vehicle is handed over with a full tank of fuel and must be returned with a full tank; otherwise Virage Montecito reserves the right to charge for the missing fuel at the prevailing retail price plus a refuelling handling fee.

4.2 Mileage is unlimited for driving within the territory of Montenegro, unless expressly stated otherwise in the booking confirmation.

4.3 At pick-up a vehicle condition report (exterior, interior, fuel level, mileage, existing damage) is prepared and signed by both parties. The Driver must carefully inspect the vehicle before signing and report any observations. A vehicle returned with no newly reported damage is compared against the pick-up report to identify any damage arising during the rental period.

5. PRICE, PAYMENT AND SECURITY DEPOSIT

5.1 Payment for the rental is made, at the Driver's choice, in cash or by card at vehicle pick-up ("Pay on Arrival"), or electronically before pick-up ("Pay Online") where that option is available, processed securely by our payment service provider, Monri, with any discount applying only to bookings paid in full in advance by electronic payment.

5.2 If the Driver does not settle the full rental amount at pick-up (for the Pay on Arrival option), Virage Montecito reserves the right to refuse to hand over the vehicle.

5.3 A refundable security deposit is charged at pick-up, the exact amount of which depends on the selected vehicle model and will be confirmed to the Driver before or at pick-up. The deposit is held or charged on the Driver's payment card and refunded within up to 14 (fourteen) days of vehicle return, less any amounts due under clauses 8 and 9 (damage, fuel, fines, cleaning, etc.).

5.4 Virage Montecito reserves the right to deduct from the deposit, and where necessary to charge separately to the same payment card, the following: any vehicle damage not covered by insurance or falling within the excess; missing fuel; extraordinary cleaning charges; lost or damaged vehicle equipment; traffic fines and associated administrative costs; and any other cost arising from non-compliance with these Conditions.

6. TERRITORIAL DRIVING RESTRICTIONS

6.1 Unless otherwise agreed, the vehicle may be used only within the territory of Montenegro.

6.2 Taking the vehicle outside the borders of Montenegro is permitted only with a pre-booked "Border-Crossing Permit" extra and Virage Montecito's prior written approval confirming the permitted countries/route. Crossing a border without prior approval constitutes a material breach of these Conditions, voids insurance cover in full, and entitles Virage Montecito to immediately terminate the rental agreement and demand the immediate return of the vehicle at the Driver's expense, without prejudice to the right to claim full damages.

7. PROHIBITED USE OF THE VEHICLE

The Driver is expressly prohibited from using the vehicle for: (a) participation in any kind of race, speed test or off-road trial; (b) sub-letting, lending to third parties, or the paid carriage of passengers/goods (e.g. taxi or ride-sharing services) without prior written approval; (c) towing other vehicles or trailers; (d) transporting flammable, explosive, toxic or otherwise hazardous materials; (e) off-road driving on unpaved terrain, unless the vehicle is expressly intended and approved for such use; (f) driving under the influence of alcohol, narcotics, psychoactive substances, or medication affecting the ability to drive; (g) carrying a number of passengers or a load exceeding the vehicle's technical specifications; and (h) any other use contrary to the applicable road-safety regulations of Montenegro.

Breach of any provision of this clause constitutes a material breach of the agreement, voids insurance cover in full, and entitles Virage Montecito to immediately terminate the agreement and demand the immediate return of the vehicle, with the right to claim full damages and all costs incurred.

8. INSURANCE AND EXCESS

8.1 Every vehicle in the Virage Montecito fleet carries mandatory third-party liability insurance as required by law, as well as basic collision damage waiver (CDW) cover for damage to the vehicle itself arising from a traffic accident, subject to an excess (deductible) in the amount stated in the rental agreement.

8.2 Purchasing the "Premium Insurance" extra significantly reduces the excess amount, in accordance with the terms in effect on the booking date, as confirmed in the rental agreement.

8.3 Basic and Premium insurance do not cover, and the Driver remains fully liable for: damage to tyres, wheels, glass, mirrors, the underbody and the interior arising from careless handling; loss or damage to keys, vehicle documents or equipment; damage arising from breach of clause 6 (territorial restrictions) or clause 7 (prohibited use); damage occurring while the vehicle is driven by an unregistered person; and any damage arising from gross negligence, wilful misconduct, or in connection with a criminal offence.

8.4 In the event of a traffic accident, theft, or damage to the vehicle, the Driver must, immediately and no later than within 24 hours: (a) notify the competent police authority and obtain a police report/confirmation of the incident; (b) immediately notify Virage Montecito by phone and in writing using the contact details in clause 15; and (c) not leave the scene nor admit liability to any third party before the police arrive. Failure to comply with these obligations may result in the loss of insurance cover and full financial liability of the Driver.

9. VEHICLE CONDITION AT RETURN

9.1 The vehicle must be returned in the same condition as at pick-up (normal wear and tear excepted), clean inside and out, with a full tank of fuel and all equipment intact.

9.2 For a vehicle returned in a condition requiring extraordinary cleaning (e.g. food, drink, tobacco/pet odour residue, mud beyond normal levels), Virage Montecito reserves the right to charge a flat cleaning fee in the amount stated in the extras price list.

10. RENTAL EXTENSION AND LATE RETURN

10.1 Any extension of the rental period must be approved in advance by Virage Montecito, subject to vehicle availability and payment of the applicable price difference.

10.2 Returning the vehicle after the grace period in clause 3.2 without a previously approved extension is charged at the prevailing daily rate plus a flat late-return fee, and after 24 hours of unauthorised retention of the vehicle Virage Montecito reserves the right to report the vehicle to the competent authorities as unlawfully withheld, without prior notice.

11. LIABILITY FOR TRAFFIC OFFENCES AND FINES

The Driver bears full liability for all traffic offences, parking fines, tolls, illegal-parking penalties and other monetary fines incurred during the rental period, including those received by Virage Montecito after the end of the rental that relate to the period the vehicle was with the Driver. Virage Montecito reserves the right to charge such fines, plus an administrative processing fee, against the deposit or directly to the Driver's payment card, and to provide the Driver's details to the competent authorities as required by law.

12. CANCELLATION AND AMENDMENT

12.1 The Driver may cancel or amend a booking by contacting Virage Montecito using the contact details in clause 15, subject to the following: cancellation at least 48 hours before the scheduled pick-up - free of charge; cancellation less than 48 hours before pick-up, or a no-show - Virage Montecito reserves the right to charge a fee of up to one day's rental at the applicable price list, to cover the lost opportunity to rent the vehicle to another customer.

12.2 Where a booking has been prepaid electronically, any refund due under the preceding paragraph will be made using the same payment method, within a reasonable time.

13. LIABILITY AND LIMITATION OF LIABILITY

13.1 Virage Montecito is responsible for the technical roadworthiness of the vehicle at the time it is handed over to the Driver, in accordance with applicable Montenegrin regulations.

13.2 Virage Montecito is not liable for: indirect loss, loss of profit, loss of time, missed business or personal commitments, nor any other consequential loss arising from vehicle breakdown, delay in vehicle handover due to circumstances beyond Virage Montecito's control (force majeure, delay by a prior renter, a technical fault discovered immediately before handover, etc.), loss or theft of the Driver's or passengers' personal belongings left in the vehicle, nor any loss arising from the Driver's breach of these Conditions.

13.3 In any event, Virage Montecito's total liability to the Driver under the rental agreement is limited to the rental price actually paid for the specific booking, except for loss caused by Virage Montecito's wilful misconduct or gross negligence, which liability cannot be limited by contract.

14. FORCE MAJEURE

Neither party shall be liable for failure or delay in performing its obligations under these Conditions where this results from circumstances beyond its reasonable control (force majeure), including but not limited to: natural disasters, epidemics/pandemics, acts of war, terrorism, strikes, measures imposed by public authorities, and interruption of energy or telecommunications supply.

15. CONTACT AND COMPLAINTS

Any complaints, remarks or requests relating to a vehicle rental may be sent to: email info@viragemontecito.me, phone +382 67 205 010, or by post to 17 Josipa Broza Tita, Podgorica 81000, Montenegro. Virage Montecito aims to respond to all complaints within a reasonable time, and no later than the period prescribed by the Consumer Protection Law of Montenegro.

16. GOVERNING LAW AND JURISDICTION

These Conditions, and every rental agreement concluded under them, are governed by the laws of Montenegro. Any dispute the parties are unable to resolve amicably shall be subject to the jurisdiction of the competent court in Podgorica.

17. CHANGES TO THESE CONDITIONS

Virage Montecito reserves the right to amend these Conditions at any time. Amendments are published on this page with the date of the last update and apply to bookings made after publication, while already-confirmed bookings remain governed by the Conditions in effect on the date of booking confirmation.
